The above-captioned case was scheduled for hearing on June 19, 2007 at 1:00 P.M. At that time, Acting Chairman Newbrook and Commissioners Blackburn, Jasparro, Preiss, Jackson, Filippi and OConnell were present. The fire service was represented by Assistant Deputy State Fire Marshal and Chief Harry Hallgring of the Little Compton Fire Marshals Office. During the hearing, the Board was advised that the Little Compton Fire Marshal's office sought a determination as to whether a storage building providing accessory storage to a residential occupancy with no access to the public or employees should be regulated as a storage occupancy under Chapter 42 of the Life Safety Code, or should be deemed a component of the residential occupancy. Upon review of this facility, it was the determination of the Board that the cited building, based upon the facts presented, would qualify as a residential storage building as opposed to a commercial storage occupancy. Accordingly, this residential storage occupancy would not be regulated under the State Fire Code.
