The above-captioned cases were scheduled for hearing on April 5, 2005 at 1:00 P.M.  At that time, Chairman Farrell, Vice Chairman Coutu and Commissioners Preiss, Pearson, Burlingame, Filippi and OConnell were present.  The fire service was represented by Assistant Deputy State Fire Marshal Gerald Bessette of the Barrington Fire Marshals Office.  A motion was made by Commissioner Coutu and seconded by Commissioner Burlingame to approve the Applicants plan of action as outlined herein.  The motion was unanimous.

FINDINGS OF FACT
	The Board had previously reviewed the Center for the Arts facility identified as file number 040147, and issued a decision on September 16, 2004.  The Applicant has returned with several other buildings to be reviewed.  The entire group of buildings was scheduled for hearing on March 1, 2005.  At that time, it was determined that an on-site subcommittee of the Board be assigned to this complex.  The on-site was conducted on March 9, 2005.  During the sub-committee review, the Applicant was directed to work with the Barrington Fire Marshals office in the development of an approved plan of action for this complex.  The Board finds that the Applicants plan of action was completed on March 30, 2005 and the Board hereby incorporates the Applicants plan of action as its initial findings of fact.  Any modification of the Boards findings, such as correction of a deficiency by the Applicant, shall be noted herein. 
	Any deficiency understood by the Board to have been corrected, which is not so corrected, shall be immediately corrected by the Applicant.  The term approved, as used herein, is understood to mean in accordance with the specific provisions related to the particular subject as are contained in this Code, or as approved in particular by the State Fire Marshal.

CONCLUSIONS AND VARIANCE REQUESTS
Jones Gym
	1.  The Board hereby directs the Applicant to correct deficiency 1 by providing a path from the exits to the public way, at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	2.  The Board hereby directs the Applicant to correct deficiency 2 by providing approved emergency lighting outside the music room, on or before December 31, 2005.
	3.  It is the understanding of the Board that the Applicant has corrected deficiency 3 and that the northeast door is fully functional.
	4.  It is the understanding of the Board that the Applicant has corrected deficiency 4 by providing approved flame rating for the stage curtains of this facility.
	5.  It is the understanding of the Board that the Applicant has corrected deficiency 5 by providing this facility with an approved remote boiler shut off switch.
	6.  It is the understanding of the Board that the Applicant has corrected deficiency 6 by providing approved housekeeping in the art and music rooms of this facility.
	7.  It is the understanding of the Board that the Applicant has corrected deficiency 7 by providing monthly inspection of the fire extinguishers.
	8.  The Board hereby directs the Applicant to correct deficiency 8 by providing this facility with an approved upgraded fire alarm system, installed at the direction and to the satisfaction of the Barrington Fire Marshal, on or before December 31, 2005
	9.  The Board hereby directs the Applicant to correct deficiency 9 by providing the fire alarm system of this facility with an approved drill switch on or before December 31, 2005.
Brown Science Building
	1.  It is the understanding of the Board that the Applicant has corrected deficiency 1 by having its agents continually monitor the halls, doors and stairs of this facility to ensure compliance with the fire code.
	2.  The Board hereby directs the Applicant to correct deficiency 2 by providing an approved exit to the public way and to further pave this exit and maintain it free of any snow and ice at all times.  The above path shall be approved by the Barrington Fire Marshals office and installed on or before July 1, 2006.
	3.  The Board hereby directs the Applicant to correct deficiency 3 at the direction and to the satisfaction of the Barrington Fire Marshal.  In the event the parties are unable to determine the best method for correction, this file shall be open for further Board review if deemed necessary.
	4.  It is the understanding of the Board that the Applicant has corrected deficiency 4 by providing monthly inspection of the fire extinguishers of this facility.
	5.  The Board hereby directs the Applicant to correct deficiency 5 by providing the fire alarm systems of this facility with an approved drill switch, at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	6.  It is the understanding of the Board that the Applicant has corrected deficiency 6 by providing approved access roads to this facility.
	7.  The Board hereby directs the Applicant to upgrade the fire alarm system of this facility, at the direction and to the satisfaction of the Barrington Fire Marshal, on or before December 31, 2005.

Clark Hall
	1.  The Board hereby grants a variance from the provisions of NFPA 101 separation requirements in order to accept the wood lathe and plaster ceiling with 5/8 inch sheetrock as an approved separation from the assembly areas of this facility.  In granting this relief, the Board notes that the Applicant has provided approved one-hour doors to separate the halls from the assembly and has a second means of egress through the assembly with a third emergency means of egress by fire escape.  In light of the above, it is the understanding of the Board that the Barrington Fire Marshals office has no objection.
	2.  It is the understanding of the Board that the Applicant has corrected deficiency 2 by providing the stairs to the basement with an approved hand rail, installed at the direction and to the satisfaction of the Barrington Fire Marshal.
	3.  The Board directs the Applicant to correct deficiency 3 by providing approved emergency lighting at all exits, on or before December 31, 2005.
	4.  It is the understanding of the Board that the Applicant has corrected deficiency 4 by providing the required interior finish.
	5.  It is the understanding of the Board that the Applicant has corrected deficiency 5 by repairing the cited holes in the boiler room area.
	6.  The Board hereby directs the Applicant to correct deficiency 6 by providing approved exit signage in the basement on or before December 31, 2005.
	7.  It is the understanding of the Board that the Applicant has corrected deficiency 7 by providing the boiler with an approved remote switch.
	8.  It is the understanding of the Board that the Applicant has corrected deficiency 8 by providing approved housekeeping in the basement of this facility.
	9.  It is the understanding of the Board that the Applicant has corrected deficiency 9 by providing approved monthly fire extinguisher checks in the facility.
	10.  The Board hereby directs the Applicant to correct deficiency 10 by upgrading the fire alarm system of this facility at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	11.  The Board hereby directs the Applicant to correct deficiency 11 by providing the fire alarm system with an approved drill switch, at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.

Peck
	1.  The Board hereby directs the Applicant to correct deficiency 1 by providing a path from the exit to the public way, constructed and maintained at the direction and to the satisfaction of the Barrington Fire Marshal, on or before December 31, 2005.
	2.  It is the understanding of the Board that the Applicant has corrected deficiency 2 by providing monthly inspection of the fire extinguishers of this facility.
	3.  The Board hereby directs the Applicant to upgrade the fire alarm system of this facility, at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	4.  It is the understanding of the Board that deficiency 4 is moot because this is a building that is used exclusively for business and not education.

Fitness Center

	1.  The Board hereby directs the Applicant to correct deficiency 1 by providing this facility with emergency lighting, at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	2.  The Board hereby directs the Applicant to correct deficiency 2 by providing an approved path from the exit to the public way, constructed and maintained, at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	3.  It is the understanding of the Board that the Applicant has corrected deficiency 3 by repairing the cited holes in the boiler room walls and ceilings.
	4.  It is the understanding of the Board that the Applicant has corrected deficiency 4 by providing approved monthly checks of the fire extinguishers in this facility.
	5.  The Board hereby directs the Applicant to correct deficiency 5 by providing the fire alarm system with an approved drill switch, installed at the direction and to the satisfaction of the Barrington Fire Marshal, on or before December 31, 2005.

Chapel
	1.  The Board hereby directs the Applicant to correct deficiency 1 by providing this facility with approved emergency lighting, installed at the direction and to the satisfaction of the Barrington Fire Marshal, on or before December 31, 2005.
	2.  The Board hereby directs the Applicant to correct deficiency 2 by providing the cited exit doors with approved panic or fire exit hardware, installed at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	3.  The Board hereby directs the Applicant to correct deficiency 3 by providing this facility with approved emergency lighting, installed at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	4.  The Board hereby directs the Applicant to correct deficiency 4 by providing this facility with approved exit signage, installed at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	5.  It is the understanding of the Board that the Applicant has corrected deficiency 5 by properly protecting the boiler room of this facility.
	6.  It is the understanding of the Board that the Applicant has corrected deficiency 6 by providing an approved interior finish in the anteroom of this facility.
	7.  The Board hereby directs the Applicant to provide the Chapel of this facility with an approved interior finish, as deemed necessary by the Barrington Fire Marshals office, on or before March 31, 2006.  The Board notes that the Chapel is not currently used for student assembly.
	8.  The Board hereby directs the Applicant to correct deficiency 8 by upgrading the fire alarm system of this facility, at the direction and to the satisfaction of the Barrington Fire Marshals office on or before December 31, 2005.

Sage Gym
	1.  The Board hereby directs the Applicant to correct deficiency 1 by providing an approved path from the exit to the public way, constructed and maintained at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	2.  During the April 5, 2005 hearing on this matter, the Board was advised that this building is fully sprinklered and that, as such, could be considered as a Class B flame spread equivalent.  Accordingly, the Board hereby directs the Applicant to correct deficiency 2, if necessary, at the direction and to the satisfaction of the Barrington Fire Marshals office.
	3.  The Board hereby directs the Applicant to correct deficiency 3 by providing the fire alarm system with an approved drill switch, installed at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	4.  It is the understanding of the Board that the Applicant has corrected deficiency 4 by providing monthly checks of the fire extinguishers of this facility.

Perry Hall
	1.  The Board hereby directs the Applicant to correct deficiency 1 by providing the front door of this facility with approved panic or fire exit hardware, installed at the direction and to the satisfaction of the Barrington Fire Marshals office on or before December 31, 2005.
	2.  The Board hereby directs the Applicant to correct deficiency 2 by providing an approved door at the top of the stairs at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	3.  The Board hereby directs the Applicant to correct deficiency 3 by providing the first floor of this facility with approved one-hour rated self-closing doors, installed at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	4.  The Board hereby directs the Applicant to correct deficiency 4 by providing an approved one-hour self closing door in the hall to the exit, installed at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	5.  The Board hereby directs the Applicant to correct deficiency 5 by providing an approved one-hour rated self closing door to the boiler room of this facility, on or before December 31, 2005.
	6.  The Board hereby directs the Applicant to correct deficiency 6 by removing the cited soda machine from the exit access way, on or before June 30, 2005.
	7.  The Board hereby directs the Applicant to correct deficiency 7 by sheet rocking the old doorway opposite to the basement door of this facility, at the direction and to the satisfaction of the Barrington Fire Marshal, on or before June 30, 2005.
	8.  It is the understanding of the Board that the Applicant has corrected deficiency 8 by properly sheet rocking the cited wall and repairing the ceiling of the laundry room of this facility.
	9.  It is the understanding of the Board that the Applicant has corrected deficiency 9 by providing approved interior wall and ceiling finishes within this facility.
	10.  The Board hereby directs the Applicant to correct deficiency 10 by providing approved exit signage in the back hall of the basement, installed at the direction and to the satisfaction of  the Barrington Fire Marshals office, on or before December 31, 2005.
	11.  The Board hereby directs the Applicant to correct deficiency 11 by providing fire rated glass or an approved equivalent in the windows impinging on the fire escape system, at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before July 1, 2006.
	12.  The Board hereby directs the Applicant to provide this facility with approved carbon monoxide detection installed at the direction and to the satisfaction of  the Barrington Fire Marshals office, on or before December 31, 2005.
	13.  The Board hereby directs the Applicant to correct deficiency 13 by providing approved smoke detection with battery back-up in all sleeping rooms of this facility on or before December 31, 2005.
	14.  The Board hereby grants a variance in order to allow the Applicant to maintain the existing means of escape from all of the dorm rooms of this facility, as modified above.  In granting this variance, the Board notes that there are three (3) means of egress from the second floor and two (2) doors to the fire escape stairs.  The Board notes that the windows for emergency means of escape from the rooms of this facility are not the full recommended dimension.  However, the Board further notes that upon on-site inspection, that these windows are appropriate for an approved emergency means of escape.  In granting this variance the Board notes that the Barrington Fire Marshals office has no objection.
	15.  As a further condition of the above relief, the Board directs the Applicant to upgrade the fire alarm system of this facility, at the direction and to the satisfaction of the Barrington Fire Marshals office on or before December 31, 2005 and to further provide the fire alarm system with an approved drill switch, installed at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.

Cady House
	1.  The Board hereby directs the Applicant to correct deficiency 1 by providing two (2) approved exits from each floor of this facility, at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before July 31, 2006.  
	2.  The Board hereby directs the Applicant to correct deficiency 2 by providing an approved remote second exit from the primary exit of this facility, at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before July 31, 2006.
	3.  The Board hereby directs the Applicant to correct deficiency 3 by providing approved illumination of all of the exits of this facility, at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	4.  It is the understanding of the Board that the Applicant has corrected deficiency 4 by providing approved interior wall and ceiling finish throughout this facility.
	5.  The Board hereby directs the Applicant to correct deficiency 5 by providing panic and fire exit hardware on the doors of this facility, at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before September 30, 2005.
	6.  It is the understanding of the Board that the Applicant has corrected deficiency 6 by discontinuing the practice of chocking open the fire doors.  The Board directs the Applicant to continually monitor these doors to ensure that the doors remain closed or are allowed to stay open only on approved magnetic hold-open devices.
	7.  The Board hereby grants a variance in order to allow the Applicant to maintain the existing  1  inch solid core fire doors in this facility.  In granting this variance, it is the understanding of the Board that these doors were most probably originally rated.  However, the labels are either missing or have been destroyed.
	8.  It is the understanding of the Board that the Applicant has corrected deficiency 8 by providing approved fire extinguishers outside of the laundry room of this facility.
	9.  The Board hereby directs the Applicant to correct deficiency 9 by providing emergency instructions for the residents of this facility, on or before August 31, 2005.
	10.  It is the understanding of the Board that the Applicant has corrected deficiency 10 by conducting regular fire drills in this facility and that the Applicant shall continue to conduct the fire drills to the satisfaction of the Barrington Fire Marshals office.
	11.  It is the understanding of the Board that the Applicant has corrected deficiency  11 by providing the boiler room with an approved enclosure.
	12.  The Board hereby grants a variance in order to allow the Applicant to maintain the existing means of escape from the dorm rooms of this facility.  In granting this variance, the Board notes that the Applicant has sufficient alternative exits from this facility.
	13.  The Board hereby directs the Applicant to upgrade the fire alarm system of this facility at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	14.  It is the understanding of the Board that the Applicant has corrected deficiency  14 by repairing the cited holes in the laundry and boiler room ceilings, at the direction and to the satisfaction of the Barrington Fire Marshals office.
	15.  The Board hereby directs the Applicant to correct deficiency 15 by providing approved exit paths from the exits to the public way, constructed and maintained at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.
	16.  The Board hereby directs the Applicant to correct deficiency 16 by providing an approved carbon monoxide detector in the apartment above the boiler room of this facility, on or before December 31, 2005.

Hardy Hall
	1.  It is the understanding of the Board that the Applicant has corrected deficiency  1 and that the exits, halls and stairways of this facility shall be routinely inspected by the teachers and principal to assure their remaining unobstructed and completely functional.
	2.  The Board hereby directs the Applicant to correct deficiency 2 by repairing the cited emergency lighting outside the northeast exit on or before December 31, 2005.
	3.  It is the understanding of the Board that the Applicant has corrected a portion of deficiency 3.  Accordingly, the Board directs the Applicant to correct the remainder of deficiency 3 by providing approved interior wall and ceiling finish installed at the direction and to the satisfaction of  Barrington Fire Marshals office on or before December 31, 2005.
	4.  It is the understanding of the Board that the Applicant has corrected deficiency  4 and that the cited fire escape door is in proper working order.
	5.  It is the understanding of the Board that the Applicant has corrected deficiency  5 and that the emergency lighting in the library is in proper working order.
	6.  It is the understanding of the Board that the Applicant has corrected deficiency  6 by repairing the cited holes in the ceilings and walls of the boiler room of this facility.
	7.  It is the understanding of the Board that the Applicant has corrected deficiency  7 by providing approved monthly checks of the fire extinguishers of this facility.
	8.  The Board hereby directs the Applicant to correct deficiency 8 by discontinuing the use of the hallway as a computer laboratory, on or before July 31, 2006.
	9.  The Board hereby directs the Applicant to correct deficiency 9 by upgrading the fire alarm system of this facility, at the direction and to the satisfaction of the Barrington Fire Marshal, on or before December 31, 2005.
	10.  The Board hereby directs the Applicant to correct deficiency 10 by providing the fire alarm system of this facility with an approved drill switch, installed at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before December 31, 2005.

Coleman House
	1.  The Board hereby directs the Applicant to correct deficiency 1 by providing the cited exits with approved illumination, installed at the direction and to the satisfaction of  the Barrington Fire Marshals office, on or before December 31, 2005.
	2.  It is the understanding of the Board that the Applicant has corrected deficiency  2 by providing approved interior wall and ceiling finish on this facility.
	3.  The Board hereby grants a variance in order to allow the Applicant to maintain the existing 1 3/8 inch solid core wood doors within the egress system of this facility.  As a condition of this variance, the Board directs the Applicant to repair or replace all doors that are in disrepair or missing, on or before September 30, 2005.
	4.  The Board hereby directs the Applicant to correct deficiency 4 by providing approved self-closing and latching devices on the doors to the dorm rooms of this facility, on or before August 31, 2005.
	5.  The Board hereby directs the Applicant to correct deficiency 5 by providing the residents of this facility with approved emergency instructions on or before August 31, 2005.
	6.  It is the understanding of the Board that the Applicant has corrected deficiency  6 by providing approved regular fire drills from this facility, and that the Applicant shall continue to do so.
	7.  The Board hereby directs the Applicant to correct deficiency 7 by providing an approved carbon monoxide detector in the apartment unit above the boiler room of this facility on or before December 31, 2005.
	8.  It is the understanding of the Board that the Applicant has corrected deficiency  8 by repairing the cited holes in the walls and ceiling of the boiler room of this facility.
	9.  The Board hereby directs the Applicant to correct deficiency 9 by either removing or properly segregating the dryer from the exit access way of this facility, prior to the commencement of the 2005-2006 school year.  If the Applicant chooses to segregate the dryer, the segregation shall be approved by the Barrington Fire Marshals office as to design and rating.
	10.  The Board hereby directs the Applicant to correct deficiency 10 by providing approved pull stations at 48 inches with double action on or before December 31, 2005.
	11.  The Board hereby leaves item 11 open in order to allow the Applicant to develop and submit a plan of action for the lounge area of this facility.  Specifically, the Applicant shall either correct this deficiency or close this lounge area, on or before the commencement of the 2005-2006 school year.  A plan of action for correction should be reviewed by and approved by the Barrington Fire Marshals office.  In the event the Applicant and the Barrington Fire Marshals office cannot reach agreement on such a plan, the Applicant is free to re-submit a plan of action under the original file number in this case, 040463.
	12.  It is the understanding of the Board that the Applicant has corrected deficiency  12 by providing monthly inspections of the fire extinguishers in this facility.  The Board hereby directs the Applicant to continue the monthly monitoring of the fire extinguishers.

Stone Academic Center
	1.  It is the understanding of the Board that the Applicant has corrected deficiency 1 and that the teachers and principals within this facility shall continue to inspect the exits, hall and stairways to the satisfaction of the Barrington Fire Marshals office.
	2.  It is the understanding of the Board that the Applicant has corrected deficiency 2 and that the cited doors have been repaired at the direction and to the satisfaction of the Barrington Fire Marshals office.
	3.  The Board hereby grants the Applicant a time variance until October 31, 2005 in order to correct deficiency 3 by providing the ceiling in the gallery with an approved finish, installed at the direction and to the satisfaction of the Barrington Fire Marshals office.
	4.  It is the understanding of the Board that the Applicant has corrected deficiency  4 by repairing the cited exit door in the gallery, to the satisfaction of the Barrington Fire Marshal.
	5.  It is the understanding of the Board that the Applicant has corrected deficiency  5 by removing the cited stage curtain.  In the event the Applicant replaces the cited stage curtain, the Applicant is directed to bring it into compliance with the provisions of NFPA 101 and its referenced standards.
	6.  It is the understanding of the Board that the Applicant has corrected deficiency  6 by providing proper inspection of the fire extinguishers outside of room six.
	7.  It is the understanding of the Board that the Applicant has corrected deficiency  7 by providing monthly inspections of all of the fire extinguishers of this facility.
	8.  It is the understanding of the Board that the Applicant has corrected deficiency  8 by properly rating the ceiling of the boiler room of this facility.
	9.  It is the understanding of the Board that the Applicant has corrected deficiency  9 by repairing the cited holes in the boiler room walls of this facility.
	10.  It is the understanding of the Board that the Applicant has corrected deficiency  10 by replacing the cited smoke doors at the east end of the hall.
	11.  The Board hereby grants the Applicant a time variance until December 31, 2005 to provide this facility with an upgraded fire alarm system, in accordance with the code, at the direction and to the satisfaction of the Barrington Fire Marshals office.
	12.  The Board hereby grants the Applicant a time variance until December 31, 2005 to provide the fire alarm system of this facility with an approved fire drill switch, installed at the direction and to the satisfaction of the Barrington Fire Marshals office.

Bills House
	1.  The Board hereby directs the Applicant to correct deficiency 1 by providing proper illumination of the exits of this facility on or before December 31, 2005.
	2.  It is the understanding of the Board that the Applicant has corrected deficiency  2 by providing the interior walls and ceilings with an approved finish, at the direction and to the satisfaction of the Barrington Fire Marshal.
	3.  The Board hereby grants the Applicant a time variance until September 30, 2005 in order to provide approved panic and fire exit hardware throughout this facility, at the direction and to the satisfaction of the Barrington Fire Marshals office.
	4.  It is the understanding of the Board that the Applicant has corrected deficiency  4 and shall continue the practice of not chocking the fire doors open.
	5.  The Board hereby leaves deficiency 5 open to be corrected at the direction and to the satisfaction of the Barrington Fire Marshal.  Specifically, the Applicant has 1 inch hollow metal doors with wire glass.  The Applicant is directed to either prove to the satisfaction of the Barrington Fire Marshals office that these doors maintain an approximate fire rating deemed necessary by the Barrington Fire Marshal or to replace the doors at the direction and to the satisfaction of the Barrington Fire Marshals office.  In the event that there is a question on this requirement, the parties are free to return to the Board for further review.
	6.  The Board hereby directs the Applicant to correct deficiency 6 by providing approved emergency instruction for the residents of this facility on or before August 31, 2005.
	7.  The Board understands that the Applicant has corrected deficiency 7 and is currently conducting regular fire drills and shall continue this practice at the direction and to the satisfaction of the Barrington Fire Marshals office.
	8.  The Board hereby grants a variance in order to allow the Applicant to maintain the existing window size on those windows utilized as a means of escape from the dorm rooms of this facility.  This variance is based on structural hardship and granted in light of the Applicants alternative means of egress from this facility.
	9.  The Board hereby grants the Applicant a time variance, until December 31, 2005, to provide this facility with an approved fire alarm system in accordance with the code, at the direction and to the satisfaction of the Barrington Fire Marshals office.
	10.  The Board hereby grants the Applicant a time variance, until December 31, 2005, to provide the alarm system with an approved fire alarm switch, installed at the direction and to the satisfaction of the Barrington Fire Marshals office.
	11.  It is the understanding of the Board that the Applicant has corrected deficiency  11 by repairing the cited holes in the laundry and boiler room ceilings to the satisfaction of the Barrington Fire Marshals office.  
	12.  The Board hereby grants the Applicant a time variance, until December 31, 2005, to provide a path for the exits to the public way, installed at the direction and to the satisfaction of the Barrington Fire Marshals office.
	13.  The Board hereby directs the Applicant to correct deficiency 13 by providing an approved carbon monoxide detector in the apartment adjacent to the boiler room of this facility.  The Board hereby grants the Applicant a time variance until December 31, 2005 to correct this deficiency as part of its fire alarm system plan for this facility.
	14.  It is the understanding of the Board that the Applicant has corrected deficiency  14 and that the doors on rooms 23 and 29 are currently in good working order.
	15.  It is the understanding of the Board that the Applicant has corrected deficiency  15 and that the emergency exit door on the west side of the foyer is properly maintained and in good working order.
	16.  The Board hereby directs the Applicant to correct deficiency 16 by either providing structural documentation that the fire escape is safe or by repairing the same at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before August 31, 2005.
	17.  The Board hereby grants the Applicant a time variance until December 31, 2005 to repair the cited emergency lighting within this facility.
	18.  The Board hereby grants the Applicant a time variance until December 31, 2005 to provide a carbon monoxide detector in the apartment above the boiler room in this facility.
	19.  The Board hereby directs the Applicant to correct deficiency 19 by properly inspecting the fire extinguishers of this facility on a monthly basis.

Gardiner Hall
	1.  It is the understanding of the Board that the Applicant has corrected deficiency  1 by providing the interior wall and the ceiling with an approved finish.
	2.  It is the understanding of the Board that the Applicant has corrected deficiency  2 by connecting the ansul system to the fire alarm system of this facility.
	3.  It is the understanding of the Board that the Applicant has corrected deficiency  3 by repairing the cited holes in the boiler room ceiling.  
	4.  It is the understanding of the Board that the Applicant has corrected deficiency  4 by repairing the holes in the walls and ceiling of the utility room.
	5.  The Board hereby grants the Applicant a time variance until April 30, 2005 to correct deficiency 5 by replacing the temporary wire to the freezer with permanent wiring.
	6.  It is the understanding of the Board that the Applicant has corrected deficiency  6 by providing approved monthly inspections of the fire extinguishers of this facility.  The Board hereby directs the Applicant to continue the monthly inspections in accordance with the code.
	7.  The Board hereby grants the Applicant a time variance until December 31, 2005 in order to provide the fire alarm system of this facility with an approved drill switch, installed at the direction and to the satisfaction of the Barrington Fire Marshals office.
	8.  The Board hereby grants the Applicant a time variance until December 31, 2005 in order to provide this facility with an approved fire alarm system, at the direction and to the satisfaction of the Barrington Fire Marshals office.
	9.  The Board hereby grants the Applicant a variance in order to maintain the apartment over the cafeteria and kitchen of this facility without approved two-hour separation.  In granting this variance, it is the understanding of the Board that the apartment is occupied solely by a married couple.  As a condition of this variance, the Board directs the Applicant to attempt to provide suitable separation, at the direction and to the satisfaction of the Barrington Fire Marshals office.  When the Barrington Fire Marshals office is satisfied with the Applicants efforts, the Board shall be so satisfied.

McVickar Hall
	1.  The Board hereby directs the Applicant to correct deficiency 1 by providing an approved fire door at the top of the basement stairs of this facility at the direction and to the satisfaction of the Barrington Fire Marshals office, on or before September 30, 2005.
	2.  The Board hereby grants a variance in order to allow the Applicant to maintain the existing swing of the boiler room door.  In granting this variance on the basis of structural hardship, the Board notes that the boiler room is located in an administration building and that the Barrington Fire Marshals office has no objection.
	3.  The Board hereby grants the Applicant a time variance until December 31, 2005, to provide sufficient illumination at the exits of this building at the direction and to the satisfaction of the Barrington Fire Marshals office.
	4.  The Board hereby grants the Applicant a time variance until December 31, 2005 in order to provide this facility with emergency lighting, at the direction and to the satisfaction of the Barrington Fire Marshals office.
	5.  The Board hereby grants the Applicant a time variance until December 31, 2005, in order to provide this facility with approved exit signage, at the direction and to the satisfaction of the Barrington Fire Marshals office.
	6.  The Board hereby grants the Applicant a time variance until December 31, 2005, in order to provide the second floor of this facility with an approved second means of egress, at the direction and to the satisfaction of the Barrington Fire Marshal.
	7.  It is the understanding of the Board that the Applicant has partially completed deficiency 7.  The Board hereby grants the Applicant a time variance until September 30, 2005 in order to complete deficiency 7 by providing approved interior wall and ceiling finish at the direction and to the satisfaction of the Barrington Fire Marshals office.
	8.  It is the understanding of the Board that the Applicant has corrected deficiency  8 by repairing the cited holes in the boiler room ceiling.
	9.  The Board hereby grants the Applicant a time variance until December 31, 2005, to provide this facility with an approved fire alarm system, installed at the direction and to the satisfaction of the Barrington Fire Marshals office.
	10.  The Board hereby grants the Applicant a time variance until December 31, 2005 in order to provide this facility with approved pull stations installed at the direction and to the satisfaction of  the Barrington Fire Marshals office.  
	11.  It is the understanding of the Board that the Applicant has corrected deficiency  11 by providing this facility with approved fire extinguishers and that the Applicant is further providing monthly checks of the fire extinguishers.
	12.  It is the understanding of the Board that deficiency 12 is moot because this is a business administration building and not an educational occupancy.

STATUS OF DECISION AND APPEAL RIGHTS
	This Decision represents a comprehensive, integrated plan of fire safety for the above-captioned facility under the above-cited use or occupancy.  Accordingly, every variance granted is conditioned upon the Applicants timely and continued compliance with all of the directives of the Board.  Every variance granted is further conditioned upon the continued use or occupancy of this facility under the above-cited classification reviewed by the Board. (See:  Board Rules and Regulations, section 6-2-17).
	Failure of the Applicant to initially comply with the full Decision of the Board, within the stated time frame, shall void all variances granted herein.  (See: Board Rules and Regulations, section 6-2-18.)  In the event of complete, timely and continued compliance with the full Decision of the Board, the above cited variances shall be deemed to have vested in the above-captioned facility.  As long as this facility is in continued compliance with the full Decision of the Board, the above-cited variances shall remain with this facility in the absence of any change in use or occupancy mandating review under a separate classification of the Fire Code or a revision of the above-cited classification.  (See: Board Rules and Regulations, section 6-2-19).  Such changes in use or occupancy of this facility, or failure to continually comply with the Boards Decision shall void all variances granted under the above-cited use or occupancy.  If such change creates a new use or occupancy as outlined in R.I.G.L. 23-28.1-6, all variances granted under the original use or occupancy are void and this facility shall be reviewed under the newly created use or occupancy.  (See: Board Rules and Regulations, section 6-2-20).
	The Applicant may appeal the Boards Decision, within thirty (30) days of 
the mailing date of this Decision, by commencing an action against the State Fire Marshal in the Sixth division of the District Court.  Commencement of such an action does not operate as an automatic stay of this Decision [R.I.G.L. 42-35-15(c)].
