The above captioned case was scheduled for hearing on November 19, 2002 at 1:00 P.M.  At that time, Chairman Farrell and Commissioners Evans, Newbrook, Richard, Pearson, Coutu, Filippi, Preiss, Wahlberg and OConnell were present.  The fire service was represented by Assistant Deputy State Fire marshal Jeffrey Johnson of the Pawtucket Fire Marshals Office.  During the November 19, 2002 hearing on this matter, the Board was advised by the Applicant and the Pawtucket Fire Marshal that the parties plan to downsize this facility from four (4) apartment units to three (3) apartment units.  Accordingly, upon completion of this downsizing, the facility would fall outside of the perimeters of the State Fire Code.  The Board was further advised that the Applicant would provide a letter indicating his intention to this and is requesting that the Application be withdrawn.  In light of the above, this matter shall be held in abeyance until such time as the Board is in receipt of the Applicants letter or the Pawtucket Fire Marshals Office requests that the Board proceed under the original application.
