The Commission took the following actions:
Issued Advisory Opinion 2014-9 to George O. Steere, Jr., a member of the Glocester Town Council ("Town Council"), opining that he was not prohibited by the Code of Ethics from appearing before the Town Council to provide public comments on a zoning change application for which he received notice as an abutter, provided that he recuses from the Town Council's discussion and vote regarding the zoning change.
Issued Advisory Opinion 2014-10 to George O. Steere, Jr., a member of the Glocester Town Council ("Town Council"), opining that he was not prohibited by the Code of Ethics from appearing before the Town Council to renew an Earth Removal License, provided that he recuses from the Town Council's discussion and vote regarding his license renewal application.
Issued Advisory Opinion 2014-11 to Jason I. Simmons, a securities examiner in the Division of Securities Regulation at the Rhode Island Department of Business Regulation, opining that he is not prohibited by the Code of Ethics from engaging in private employment, on his own time, as a real estate salesperson.
Continued the advisory opinion request of Kevin Maloney, a member of the North Kingstown Town Council, to the next meeting.
Held an adjudicative hearing in the matter of In re: Lynne A. DeStefano, Complaint No. NF2013-1. The Commission unanimously found that the Respondent, a former member of the Foster Town Council, violated R.I. Gen. Laws § 36-14-16 by failing to file a 2012 Financial Disclosure Statement with the Rhode Island Ethics Commission. The Commission imposed a fine of $1500.
Approved an Informal Resolution & Settlement in the matter of In re: Albert G. Brien, Complaint No. 2013-6. The Respondent violated R.I. Gen. Laws §36-14-5(d) by sponsoring Resolutions, 13 R 108 and 13 R 113, to appoint his business associate to the position of City Clerk, and subsequently participating in the City Council's December 2, 2013, vote to appoint his business associate to said position.
