OM 16-13 / ADV OM 16-02 Costa, et al v. Rhode Island Statewide Independent Living Council - In Re: Statewide Independent Council – VIOLATION

This Department determined that the RISILC and its leadership subcommittee is a public body for purposes of the OMA and this finding, and that the RISILC violated the OMA by failing to post minutes to the Secretary of State's website for the May 20, 2015, June 24, 2015, June 25, 2015, July 8, 2015, August 5, 2015 and August 19, 2015 meetings. We also conclude that the August 19, 2015 meeting agenda item, labeled "Office Space and Staff," was insufficient and violated the OMA since a payroll matter was discussed during this topic. Other allegations raised either did not violate the OMA and/or the complainants were not aggrieved.
