Final Report of the Kent County Grand Jury (Reported September 12, 2017)

Marshall Howard (age 24) 88 Asylum Road Warwick, RI 02886 K1-2017-0564A

The Kent County Grand Jury reported out an indictment charging Marshall Howard with one count of DUI death resulting and two counts of possession of a controlled substance.

It is alleged that on or about May 23, 2017, Howard was operating a motor vehicle under the influence of marijuana when he struck and killed David Bustin, who was walking across Main Street in Warwick. It is further alleged that at the time, Howard was in possession of fentanyl and heroin.

In addition to the indictment, the Office of Attorney General today charged Howard with one count of breaking and entering and one count of simple assault in an unrelated incident that took place on August 4, 2017.

The Warwick Police Department conducted both investigations. Howard is scheduled to be arraigned in Kent County Superior Court on September 29, 2017.
