The Ethics Commission held its 1st meeting of 2009 on January 13, 2009.

Ethics Commission Meeting January 13, 2009

At the 1st meeting of the Commission in 2009, the Commission issued the following advisory opinions:

A.O. 2009-1 to Charles A. Collins, Jr. a member of the Scituate Town Council, who is also employed in his private capacity as a part-time bus driver with S & C Collins Bus Company, Inc.("Collins Bus"), opining that, while it is not an inherent conflict of interest for him to serve on the Town Council not withstanding his association with Collins Bus, he must recuse from matters regarding his employer or the interests of his employer or busing within the Scituate school district generally.

A.O. 2009-2 to Harriet Powell, a member of the North Kingstown Planning Commission, opining that she need not recuse in matters in which the Planning Commission makes recommendations to the Town Council, notwithstanding the fact that her daughter is a new Town Council member.

A.O. 2009-3 to Michelle Cole, a member of the Chariho School Committee, opining that she need not recuse from participating in the School Committee’s review, negotiations, and vote regarding the current teachers’ contract, notwithstanding the fact that her sister-in-law is a substitute teacher in the Chariho school system.

A.O. 2009-4 to Dwight T. Farrar, a member of the Scituate Town Council, opining that the Code of Ethics does not prohibit him from participating in Town Council and Budget Committee hearings and meetings that relate to approving or rejecting the entire school and/or town budget as a whole, notwithstanding the fact that the his spouse is employed as a teacher in the Scituate school system.

A.O. 2008-23 previously issued to Robert Lafazia, a Johnston School Committee member, who is the owner and operator of La Fazia Auto Body & Auto Sales Company, Inc., was amended.

The Commission approved an Informal Resolution and Settlement in the matter of In re: Susan D. Menard, Complaint No. 2008-1.

The Commission approved an Informal Resolution and Settlement in the matter of In re: Brian R. Remy, Complaint No. 2008-7.

Discussion was had of Charles Mauti v. John Scuncio, et al., U.S. District Court C.A. No. 08-54S, Jason E. Ferrell v. Frank Caprio, Jr., et al., U.S. District Court C.A. No.08-378S, William V. Irons v. Rhode Island Ethics Commission , Superior Court C.A. No. 07-6666.

Discussion was also had regarding the Complainant's Role in the Complaint Process.
