The Statewide Grand Jury handed up an indictment yesterday, Oct. 28, naming Gerrit Musterd, also known as Jose Manuel Almeida Rodriguez, on one count of first-degree murder, one count of discharging a firearm during a crime of violence, one count of conspiracy to commit murder and one count of carrying a pistol without a license. It is alleged that Musterd murdered Michael Benson in the first degree on or about Sept. 2, 2009, and that he discharged a firearm while committing a crime of violence, to wit, murder, resulting in the death of Michael Benson. It is alleged that between the dates of July 1, 2009, and Sept. 2, 2009, Musterd conspired to do an unlawful act, to wit, murder Michael Benson. It is alleged that on or about Sept. 2, 2009, the defendant carried a pistol without a license. All of the alleged incidents took place in Pawtucket. Pawtucket Police conducted the investigation. Musterd, who is currently held without bail at the ACI, will be arraigned in Providence County Superior Court on Nov. 2, 2009.
