The Ethics Commission held its 2nd meeting of 2011 on January 25, 2011.

The Commission issued the following advisory opinions:

A.O. 2011-8 to Robert Coulter, a member of the Tiverton Town Council, opining that he may participate in and perform his public duties as they relate to a funding dispute between the Town of Tiverton and the Tiverton School Committee, notwithstanding the fact that his spouse is a member of the School Committee.

A.O. 2011-9 to Katie Kleyla, a member of the East Providence City Council, opining that she may participate in and vote on City Council decisions involving TLA-Providence, L.L.C., notwithstanding the fact that her former employer is an interested party in that business.

A.O. 2011-10 to Kazem Farhoumand, PE, a member of the Rhode Island Board of Registration for Professional Engineers, and also the Chief Engineer at the Rhode Island Department of Transportation, opining that he is not prohibited by the Code of Ethics from participating in matters before the Board of Registration for Professional Engineers that may involve his subordinates and coworkers at the RIDOT.

The Commission also considered the advisory request of George O. Steere, Jr., a member of the Glocester Town Council. The Commission voted to withdraw safe-harbor and continued the advisory request to a future meeting to consider further issues.

The Commission also considered the advisory request of David Saurette, a member of the Tiverton Planning Board. Due to a lack of five affirmative votes, no advisory opinion issued.

The Commission approved an Informal Resolution & Settlement in the case of In re: Kathryn E. Leonard, Complaint No. 2010-13. The Respondent, a member of the Newport City Council, admitted to a violation of the Code of Ethics relating to her failure to list a property located in Florida on her financial statements for the calendar years 2004-2009. The Commission imposed a civil penalty of one hundred dollars ($100).
