The Ethics Commission held its 1st meeting of 2013 on January 8, 2013.

The Commission took the following actions:

Issued Advisory Opinion 2013-1 to Richard J. Fagnant, an alternate member of the Woonsocket Zoning Board, opining that he is not prohibited by the Code of Ethics from participating in the Zoning Board's consideration of a dimensional variance application, notwithstanding that he has previously done business with the applicant.

Issued Advisory Opinion 2013-2 to Thomas P. Tighe, a member of the Jamestown Town Council, opining that he is not prohibited by the Code of Ethics from participating in the Town Council's consideration of two grievances related to the Jamestown Police Department's collective bargaining agreement, notwithstanding that he is the former Chief of the Jamestown Police Department.

Issued Advisory Opinion 2013-3 to Robert C. Schultz, Jr. PE, PLS, the Deputy Utilities Director Engineering for the City of Newport, opining that he is not prohibited by the Code of Ethics from representing the City of Newport before the Rhode Island Department of Health, notwithstanding that he was previously employed by the Rhode Island Department of Health.

Issued Advisory Opinion 2013-4 to James Bennett, the Director of Economic Development for the City of Providence, opining that he is not prohibited by the Code of Ethics from serving as the City's non-voting, ex officio member of the ProvPort Board of Directors, nor from participating the City's decision-making relative to ProvPort matters. Also opining, however, that given ProvPort's financial interest in the Petitioner's official decision-making, the Code of Ethics prohibits the Petitioner from accepting ProvPort's payment of travel expenses.

Issued Advisory Opinion 2013-5 to Christine A. Rossi, a member of the East Providence City Council, opining that she is not prohibited from serving as the City Council's representative member on the East Providence Police and Fire Pension Fund Board, provided that her official actions do not affect her husband to any greater or lesser extent than any other similarly situated beneficiary of the East Providence Police and Fire Pension Fund.

Considered the advisory opinion request of Robert T. O'Neill, M.D., a member of the Narragansett Zoning Board. Due to the fact that Dr. O'Neill was unable to attend the hearing, the Commission continued the matter to a future meeting.

Made an Initial Determination in the matter In re: Pamela Fontaine, Complaint No. 2012-2, and authorized a full investigation.
