OM 13-20 - Morgan v. Foster Board of Canvassers No Violation

The Foster Board of Canvassers ("Board") did not violate the OMA when it elected a new Chairperson of the Board during its September 6, 2012 meeting because the Board's agenda provided sufficient notice. The Board did not violate the OMA because there was no evidence that members of the Board had discussions concerning the subject matter of the September 6, 2012 meeting outside the public purview. This Department did not address complainant's allegation that the September 6, 2012 meeting was not properly posted since the complainant did not demonstrate that she was aggrieved or in any way disadvantaged by this potential allegation.
