Pawtucket Man Who Shot at Providence Police Sergeant Pleads Guilty

Attorney General Peter F. Kilmartin announced today that Duvall Carty (age 26), of Pawtucket, pleaded guilty today before Superior Court Justice Robert D. Krause to felony assault, carrying a pistol without a license and discharge of a firearm while in the commission of a crime of violence. Carty was sentenced to 27 years with 17 to serve and the remainder suspended with probation.

Had the case proceeded to trial, the State was prepared to prove that on July 27, 2013, members of the Rhode Island State Police and Providence Police assigned to the Violent Crime Task Force observed Carty in the vicinity of Jovan's nightclub on Portland Street at closing time, carrying a firearm.

As police approached Carty, he fled on foot. Police followed Carty to the JD Byrider parking lot on Broad Street, where he turned in the direction of the officers and fired the .25 caliber semi-automatic pistol weapon at Providence Police Sergeant Curt Desautels. Sergeant Desautels fired his service revolver, striking and injuring Carty.

On September 18, 2013, a Providence County Grand Jury found that the actions of Police Sergeant Desautels were legally justified.

The Rhode Island State Police and Providence Police conducted the investigation. Assistant Attorney General and Chief of the Narcotics and Organized Crime Unit James Baum prosecuted the case on behalf of the Office of Attorney General.
