The Ethics Commission held its 2nd meeting of 2009 on February 10, 2009.

Ethics Commission Meeting February 10, 2009

At the 2nd meeting of the Commission in 2009, the Commission issued the following advisory opinions:

A.O. 2009-5 to Lawrence G. Anderson, the Town Moderator for the Town of Little Compton, advising that the Code of Ethics does not prohibit him from appearing on behalf of the Sakonnet Preservation Association and the Tiverton Land Trust before various municipal entities and persons in the Towns of Tiverton, Newport, and Little Compton.

A.O. 2009-6 to Judge F. Monroe Allen, the Town of Smithfield Probate Court Judge, who is also an attorney in private practice, opining that he may file an Affidavit of Complete Administration with the Smithfield Probate Court, notwithstanding his appointment as Probate Court Judge, pursuant to the hardship exception to R.I. Gen. Laws § 36-14-5(e) .

A.O. 2009-7 to Maxine Cavanagh, a member of the Smithfield Town Council, opining that she must recuse from her duties on the Town Council in matters involving the Smithfield Land Trust’s purchase of a conservation easement on property owned by the Petitioner and her husband, but that she may represent herself before the Land Trust in regard to these matters, pursuant to the hardship exception to R.I. Gen. Laws § 36-14-5(e).

A.O. 2009-8 to Barbara Rich, a member of the Smithfield Land Trust, opining that she need not recuse from matters before the Land Trust concerning the purchase of a conservation easement from Maxine Cavanagh, notwithstanding the fact that Councilwoman Cavanagh was a member of the Smithfield Town Council when she was appointed to the Land Trust.

A.O. 2009-9 to Cheryl Iannotti, a member of the Smithfield Land Trust, opining that she need not recuse from matters before the Land Trust concerning the purchase of a conservation easement from Maxine Cavanagh, notwithstanding the fact that Councilwoman Cavanagh was a member of the Smithfield Town Council when she was appointed to the Land Trust.

A.O. 2009-10 to M. Theresa Santos, a member of the Middletown Town Council, opining that she must recuse from her duties as a Town Council member when matters concerning the Middletown Historical Society come before the Town Council, given that she is the Treasurer of the Historical Society, and thus is a business associate of that entity.

The Commission found that Probable Cause existed in the matter of In re: Frank Hyde, Complaint No. 2008-5.

The Commission approved an Informal Resolution and Settlement in the matter of In re: Patrick Sullivan, Complaint No. 2008-8.

Discussion was had of Jason E. Ferrell v. Frank Caprio, Jr., et al., U.S. District Court C.A. No.08-378S and William V. Irons v. Rhode Island Ethics Commission , Superior Court C.A. No. 07-6666.
