Ethics Commission Meeting February 24, 2009

At the 3rd meeting of the Commission in 2009, the Commission issued the following advisory opinions:

A.O. 2009-11 to Valerie Zuercher, a member of the Exeter-West Greenwich School Committee, who is also a social worker in the South Kingstown school district and a member of the South Kingstown teachers’ bargaining unit of the Rhode Island chapter of the National Education Association (“NEARI”), opining that she is not prohibited by the Code of Ethics from participating in Exeter-West Greenwich School Committee matters in which the NEARI representative of the Exeter-West Greenwich teachers’ bargaining unit, who is also the NEARI representative for her bargaining unit, is a participant.

A.O. 2009-12 to Laura Flanagan, a member of the Coventry Town Council, whose spouse is a Lieutenant in the Coventry Police Department, opining that she: 1) is prohibited from participating in contract negotiations with Local 306 of the International Brotherhood of Police Officers, but may vote on a finally negotiated contract, and that she 2) is prohibited from participating in discussion or decision-making relative to budgetary line-items that would address her spouse’s employment, but may participate in discussion or decision-making relative to approving or rejecting the entire police department budget as a whole.

A.O. 2009-13 to Scott Wolf, a member of the Zoning Board of Review for the City of Providence, who in his private capacity is the Executive Director of Grow Smart Rhode Island, opining that he may participate in and vote on a pending application before the Zoning Board of Review, notwithstanding that the applicant, Dynamo House, LLC/Struever Brothers, employs a member of the Board of Directors of Grow Smart Rhode Island, since the member of the Board of Directors of Grow Smart Rhode Island will not appear before the Zoning Board of Review in support of the application.

The Commission approved an Informal Resolution and Settlement in the matter of In re: Frank Hyde, Complaint No. 2008-5.

The Commission approved an Informal Resolution and Settlement in the matter of In re: Mark A. Baker, Complaint No. 2008-7.

The Commission found that Probable Cause existed in the matter of In re: Donna J. Hayden , Complaint No. 2008-6.

Discussion was had of Jason E. Ferrell v. Frank Caprio, Jr., et al., U.S. District Court C.A. No.08-378S.
