Ethics Commission Meeting June 2, 2009

At the 8th meeting of the Commission in 2009, the Commission issued the following advisory opinion:

A.O. 2009-23 to Stephen Archambault, a member of the Smithfield Town Council, a municipal elected position, opining that he is not prohibited from voting on matters that may involve Esmond Concerned Citizens, notwithstanding his past business association with that entity, but must recuse if Attorney Timothy Robenhymer, a current business associate, represents the Esmond Concerned Citizens before the Town Council, pursuant to R.I. Gen. Laws ยง 36-14-5(f) .

The Commission reconsidered the advisory opinion request of Christopher Warfel, P.E., a member of the Town of New Shoreham Electric Utility Generation Task Group, which had previously been considered in Advisory Opinion 2009-22. The Commission considered the additional information provided by the Petitioner and voted to reissue the original draft recommendation as previously adopted in Advisory Opinion 2009-22.

Discussion was had of William V. Irons v. The Rhode Island Ethics Commission, No. 2008-335-M.P. and 2009-01-M.P.

Discussion was had regarding the process for updating General Commission Advisories.

Discussion was had of the scheduling of a workshop regarding the participation of public officials who are union members in actions involving a different bargaining unit of the same umbrella labor union. The Commission decided to schedule a public workshop on this issue for the next Commission meeting on June 16, 2009.
