Interim Report of the Providence County Grand Jury (Reported March 1, 2016)

Please note: An indictment, information, or complaint is merely an allegation. The U.S. Constitution guarantees that a defendant is presumed innocent unless and until proven guilty in a court of law.

Marcos Hernandez (age 22) LKA: 17 Woodman Street Providence, RI P1-2016-0737AG

The Office of Attorney General today went before Superior Court Magistrate John F. McBurney to unseal an indictment charging Marcos Hernandez with the June 25, 2014 murder of 42-year-old Augustin Jaiman.

A Providence County Grand Jury returned the secret indictment on March 1, 2016, charging Hernandez with several counts related to the murder including one count of murder, one count of discharging a firearm while committing a crime or violence, one count of possession of a stolen firearm while committing a crime of violence, one count of possession of a firearm without a license, and one count of improper disposal of a body.

It is alleged that Hernandez, in possession with a stolen .380 caliber semi-automatic pistol, shot and killed Augustin Jaiman. It is further alleged that in an attempt to cover up the murder, Hernandez placed Jaiman's body in a garbage bin in a wooded area off Leander Street in Providence. The body was discovered nearly two and one months after the murder.

The Grand Jury also charged Hernandez with one count of assault with a dangerous weapon and one count of possession of a stolen firearm while committing a crime of violence. Both charges are related to an assault of an individual on or about August 8, 2014.

The indictment was sealed and a warrant was issued for the arrest of Hernandez. He was recently arrested in Orlando, FL and is being held at the Orange County Jail. No arraignment date has been set.

Providence Police Detective Casey Moffett led the investigation.
