PR 18-31 Howard v. Rhode Island Department of Environmental Management – No Violation

The Complainant alleged the Department of Environmental Management ("DEM") violated the Access to Public Records Act ("APRA") when the Complainant requested copies of certain written conservation management plans for farmland property and DEM provided four written conservation plans but did not provide nine additional plans. The evidence before this Department revealed that DEM does not have the additional records in its possession and provided the Complainant with all the files and documents it had that were responsive to her request. Because the APRA does not require "a public body to reorganize, consolidate, or compile data not maintained by the public body," R.I. Gen. Laws § 38-2-3(h), this Department found no violation of the APRA.
