PR 19-17 Farinelli v. City of Pawtucket – Violation Found

The Complainant alleged that the City violated the APRA when it provided a list of City police officers in response to her request for officer addresses, but redacted each officer's city or town of residence. We observed that the APRA expressly mandates disclosure of "the city or town of residence" of all public employees. See R.I. Gen. Laws § 38-2-2(4)(A)(b). Accordingly, by redacting the city or town of residence of City police officers, the City violated the APRA. Although we did not find evidence of a willful and knowing, or reckless, violation, we instructed the City to release the officers' city or town of residence in accordance with the APRA's requirements.
