PR 20-24 John Doe v. City of Warwick – Violation found

The Complainant alleged that the City violated the APRA when it failed to respond to his request. The City acknowledged the error, noting that a City employee mistakenly deleted the email from a "John Doe" thinking it was spam. However, the City made the undisputed assertion that once it became aware of the mistake, it responded to the request by providing the requested documents. While the City's failure to timely respond to the request violated the APRA, we found insufficient evidence of a willful and knowing, or reckless, violation and no need for injunctive relief. VIOLATION FOUND.
